WAIVER OF LIABILITY RELEASE FORM
All participants MUST complete this form
This Agreement is between the Company and the Participant.
All participants (hereinafter: the “Participant”) must complete this form before participating in any live events or related activities with Beverley Ewington (hereinafter: “the Company”).
Please understand access to the live event or related activities will not be granted if this form is not received prior to the scheduled session and/or insufficiently signed or dated.
1. The Participant hereby assumes all risk associated with their participation in the live event and/or it’s related activities, including by way of example and not limited to, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. The Participant understands this release of liability extends to any locations selected by either the Participant, the Company or any staff of the Company that may present any inherent risk, hazards, and/ or danger whether known or unknown at the time of the live event or related activities. This includes, but is not limited to, wellness activities such as sound therapy, guided meditations, journaling exercises, Human Design teachings, group discussions, and any emotional, mental, or energetic responses that may arise during these activities.
2. The Participant recognizes and understands that dependent on the nature of the live event or it’s related activities, that a certain level of fitness may be required. The Participant fully understands the risks of physical injury that may present itself throughout the live event or related activities, whether known or unknown, and The Participant fully assumes those risks involved.
3. The Participant represents and warrants that they are in good physical condition and have no medical condition and or/allergies that would prevent and/ or limit full participation in the live event or related activities. The Participant understands that these activities may involve personal reflection, emotional release, and/or shifts in perspective, and that they are responsible for their own self-care during and after the event. The Participant understands that it is their responsibility to consult with a physician prior to and in regards to their participation in the live event or related activities with the Company.
4. The Participant certifies that they have not been advised against participation in live events or related activities with the Company, by a qualified health professional.
5. In consideration of being permitted to participate in any live event or related activities with the Company, The Participant agrees to assume full responsibility for any risks, injuries and/or damages, known or unknown, which might incur as a result of participation in the live event or related activities with the Company.
6. The Participant is aware that this is a release of liability and knowingly, voluntarily and expressly waive any claim they may have against the Company for injury or damages that may be sustained as a result of participation in the live event or related activities with the Company or in connection with any instruction from the Company and its employees and/or contractors, inclusive of, staff members, volunteers, other attendees and participants, while the Participant is participating in live events or related activities.
7. The Participant further understands they are waiving certain legal rights and agree to be forever prevented from using or otherwise claiming against the Company and its providers for any personal injury that may be sustained during their participation in the live event or related activities with the Company.
8. This Agreement will be governed and construed in accordance with the law of the Province of Ontario.
The Participant has read, understands, and fully agrees to the terms of this Agreement. The Participant understands and confirms that by signing the Agreement they have given up considerable future legal rights. The Participant has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to them. The signature below is proof of the Participant’s intentions to execute a completed and unconditional Waiver and release of all liability to the full extent of the law.
